These Terms and Conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the Terms and Conditions set out below. We reserve the right to amend these Terms and Conditions from time to time. It is important that users of this Website check the Terms and Conditions each time they place an order and ensure that they accept the current Terms & Conditions.

We reserve the right to modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website.

No promises and or representations of any kind, express or implied, are given as to the accuracy of any of the information contained within this Website or as to the nature, standard, suitability or otherwise of any services offered by us or on our behalf. We shall not be liable for any loss, or damage of whatever nature (direct, indirect, consequential or other) which may arise as a result, directly or indirectly, from the use of any information or material contained in this Website. Whilst every effort is made to ensure accuracy, errors can occur. You are strongly advised to check all details of your order carefully at the point of order.

We make every effort to ensure that this Website is free from viruses or defects. However, we can not guarantee that your use of this Website or any websites accessible through it won’t cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use this Website and screen out anything that may damage it. We will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this Website.

Description of Goods

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct at all times and we aim to keep the Website as up to date as possible. Packaging may vary from that show. Any weights, dimensions and capacities (if) given are approximate only. All photographs are for illustrative purposes only. Please read the product descriptions carefully.

Customer Orders

By placing an order you are deemed to have accepted our Terms and Conditions. A binding contract will only have been entered into once we have sent confirmation of receipt of your order in writing and providing that the conditions of any relevant promotional offers have been complied with. We reserve the right to cancel any orders that do not comply with the conditions of promotions and offers and refund payment.

Pricing

All prices featured are inclusive of VAT at the current rate and are payable in British Pounds. We have the right at any time to revise prices. Unless otherwise stated prices payable are exclusive of delivery and are subject to our right to require payment of delivery charges, insurance costs, customs duties, special handling charges and/or packaging charges as appropriate.

Availability

All products on the Paisley Model Centre Website are featured subject to availability. If the products you order are out of stock you will be notified and offered the option to, accept alternative products, place your order on backorder (your order will be despatched as soon as it become available) or to cancel your order. Any monies paid will be refunded to you.

Payment

Payment can be made by Credit Card or Debit Card. Payment will be debited to your account before despatch of your order. Your order will not be shipped unless payment is received in full. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party obtains unauthorised access to any data you provide when accessing or ordering from the Website.

For special pre-order items your credit/debit card will be charged at the time when your order is placed and will be despatched as soon as it is available.

Delivery

We deliver throughout the UK and Overseas. We endeavour to despatch orders within 48 hours of receipt. Orders will only be despatched once payment has been received. Orders are sent by First Class Royal Mail or DHL Courier and are usually received within 2 – 3 working days. If you have not received your order within 5 working days of receiving confirmation of despatch please contact us by email or telephone. We will trace your order and try to ensure you receive it as quickly as possible. We will not be responsible for any loss caused to you by late delivery.

Carriage Costs in the UK

Small and medium size items up to £75    £2.50, £3.50 or £4.50 depending on size and weight. Sent via standard post.
Orders up to £250 and heavy items    £6.50 DHL courier
Orders over £250    Free – DHL courier
We are happy to ship outside of the UK Mainland and to overseas. We will confirm the cost before processing your order.

Damaged or defective products

It is the customers responsibility to carefully check that all products received are undamaged and in good working condition. If, in the unlikely event, your products arrive in a damaged condition or are defective, you must inform us as soon as possible and in any event no later than 7 days after delivery. Failure to do so will deem that you have accepted the products.

Damaged product includes items that have been damaged in shipping. If a shipment arrives at your door with apparent shipping damage please make a note on the courier’s docket that the shipment is damaged and inform us. If you have already accepted delivery and then find shipping damage please contact us immediately. Please retain all packaging material and paperwork as they may be required by the courier. Please do not return any item without prior agreement from ourselves.

No goods will be replaced or refunded without first receiving the original goods back.

If goods are returned with any faults, they will be sent back to the supplier. We will wait for the supplier’s decision regarding the item before replacing or refunding the goods. If the supplier deems the item has been damaged by the customer, no refund or replacement will be given and the customer will be expected to pay the return postage of their original item and any additional costs incurred by Paisley Model Centre.

Incorrectly Sent Items

If you order an item in error, only the price of the returned goods will be refunded. The goods must be returned unused and in the original packaging. We will not despatch replacements until the incorrectly ordered item is returned to us.

Cancellation of Orders

In order to cancel an order before it has been despatched it is essential that you call us immediately and confirm in writing either by email or fax. Your order will then be cancelled and any payments made will be refunded to you. Refund payments for cancelled orders will be made to the account originally charged.

Under the EU Distance Selling Directive you have the legal right to cancel your order within 7 days of receipt of the goods if you change your mind.

Your right to cancel only applies if the returned goods are unopened and unused and in the same condition as when despatched by Paisley Model Centre. In addition the right to cancel does not apply to any simulators and software that has been opened or unsealed or any special order to your specification. If you change your mind and wish to return goods under these circumstances you must advise us which items you wish to return. When returning goods we recommend that you obtain proof of postage. We do not accept responsibility for any goods lost by the postal service you use. Once the returned goods have been received in a satisfactory condition we shall refund the cost of the goods, minus the postal charge, to the original account charged within 14 days. Customers are liable for the costs involved in returning unwanted goods to us.


Security
We have appropriate security measures in place to protect your information. We have in place suitable physical, electronic and managerial procedures to protect against the loss, misuse or alteration of information that we have collected from you at our site.

Data Privacy

When you sign up for an account all details are kept private and confidential. Your contact details will only ever be used in order to ship orders, and if necessary, to contact you regarding any orders in progress. Paisley Model Centre will not share your data with anyone else except where it is essential in the processing of your order or if required to do so by UK Governing Law.

Once your order has been processed, no further use of your data is made. We do not use them for marketing purposes and we do not pass them on to third parties for any reason whatsoever.

We do not store card data of any kind.

Severance

If any part of the Conditions within this agreement shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Conditions and shall not affect the validity and enforceability of any of the remaining conditions.

Governing Law

This Website, any content contained herein and any contract brought into being as a result of usage of this Website are governed and in accordance with Scots Law.
